"CABBZ" TERMS AND CONDITIONS FOR REGISTRATION / MEMBERSHIP OF - MY HOME MY CAB SCHEME

This application constitutes the contractual offer of the individual signed overleaf, addressed to MY HOME MY CAB A CABBZ scheme of A. S. Infra Tech Pvt. Ltd. to enter into the freelance agreement referred as Member / Chartered Cabs Managers under the terms and conditions specified below:

1. Any citizen of India aged 18years & above can become a member. MY HOME MY CAB is a Taxi Transformation program – “CABBZ” of A. S. Infra Tech Pvt. Ltd. Pvt. Ltd. Acceptance of booking / advance payment by ASITPL / MGCPL (My CAB) is merely an indication of an intention to enter in to CAB service contract and does not result in a contract of sale. AS Infra-Tech Pvt. Ltd. reserves the rights to change the terms and conditions of this scheme. The applicant agrees that MGCPL / ASITPL shall not be deemed to have accepted the Application of the Applicant or bound by the Application until ASITPL / MGCPL notifies the Applicant of its acceptance of the Application subject to the terms and conditions, contained herein.


2. The Application form should be filled only in English using BLOCK LETTERS. In any event, if any incomplete Application Form is accepted through inadvertence or oversight, MGCPL / ASITPL reserves the right to reject the same at later stages of Application process. In case of payments made by Pay Order / D.D. the validity of Application will be subject to realization of the instrument. All valid Applications will be considered for the selection of the Allottees through the process using the computerized pseudo random number generation technique (“Allotment Process”) The amount paid by the Applicants for the Application Forms is non – refundable. In case of demise of Applicant / Allotees, the booking / Allotment / retention stands cancelled and will be refunded as per refund account policy to the nominee of the applicant as mentioned by him.


3. I/We will not use the MY HOME MY CAB trade name and/or trademark except in the advertising provided to me/us by MY HOME MY CAB. Neither shall I/We advertise the voucher and or the marketing plan or MY HOME MY CAB on my/our own. I/We am/are however permitted to promote the same through personal contact, Social Media and word of mouth.


4. If I/We am/are valid permit holder to drive CAB in Mumbai. I/We must fulfill the obligation of performing a bonafide owner of the said permit issued by the Transport Authority, GOM. I/We agree to lease the said permit to MY HOME MY CAB / CABBZ / ASITPL / MGCPL for the minimum period of 10 years as per the specific terms of the scheme. I/We must maintain the vehicle as per the guidelines issued by the Company as well as RTO, GOM & GOI. I /we agree that any breach of any condition will result in suspension / cancellation of this contract. In such case the said permit levied on the vehicle will be returned to the permit holder only after the completion of the tenure of 10 years / repayment of entire loan and interest payable towards the loan of the said vehicle and house obtained under the scheme. I /We hereby give irrevocable authority to use the said permit during the tenure of 10 years or more as per the agreement.


5. I/We understand that the MY HOME MY CAB is a program built on the sale of combined scheme of House along with the one shift driving of CABBZ vehicle to the ultimate CAB Driver / Permit Holder; thereby avoiding middlemen and passing on the benefits of such direct sales in the form of strong bonding to the Member/ Driver / Permit Holder and or his Family.


6. The other benefits to the Member will be notified to him and through notification on the web site www.cabbs.in from time to time.


7. There is no obligation to the permit holder to drive the vehicle but he may opt for various schemes of the company to make smooth running of the CAB vehicle and prompt repayments of the EMI. In case of continuous defaults and irregularities in the payments of EMI or Service Charges payable by the Member / Driver or Permit Holder Company will take the possession of the said vehicle along with the permit levied on it and arrange the balance payment of the vehicle loans. Member /Permit Holder/ Driver along with their guarantors will be solely responsible for the repayment of Housing Loan. Company at any time will not be responsible for the repayment of the said housing loan. Smooth and timely repayment of the EMI and stipulated dues during the tenure of the loan is the essence of this Contract. Permit holder / Driver will pay all the due taxes, passing expenses, insurance expenses as well as maintenance expenses during the tenure of the contract. In case of continuous default Company will arrange the same at the cost of the Permit Holder / Driver. No complaint of whatsoever will be entertained in this regard. Any complaint from any passengers will be punishable and continuous complaints will attract heavy penalties as well as suspension of the contract.


8. This agreement constitutes the entire agreement between the Member and the company MY HOME MY CAB and no other additional promises, representation, guarantees or agreements of any kind are valid unless in writing and approved by MY HOME MY CAB /CABBZ / ASITPL/MGCPL management.


9. Member / Driver, Permit Holder will not be allowed to collect the part/full principle amount on behalf of the company, as the company has its own office and separate department for their customer to guide and help in all aspect. In case any passenger makes CASH Payment, Cabbz Manager (Driver) needs to disclose and deposit the said amount at the CABBZ HUB assigned to him at the time of end of his duty.


10. The amount towards the application of “MY HOME MY CAB SCHEME” and processing fees has to be paid in advance only by Cash/IMPS Transfer/NEFT/D.D./Bank Pay Order/Credit Cards to be paid online or at the authorized centers of the company A. S. Infra Tech Pvt. Ltd. The amount once paid is non-refundable and non-transferable. (for more details log on Website)


11. MY HOME MY CAB (CABBZ/ASITPL/MGCPL Management) reserves the right to reject any application without assigning any reason.*


12. The company has the right to terminate any Member without giving any prior notice if he indulges in to any misuse or fraudulent act.


13. The member shall display the MY HOME MY CAB name, CABBZ logo as designed by the company for printing his/her personal stationery (with prior permission). However, the Member shall not use the trademark, patent or any other intellectual properties of the company for anything other than for the promotion of business of the MY HOME MY CAB.


14. Upon death of the Member the right and responsibilities of the Member are passed on to the rightful nominee as per the law. The nominees shall be bound by the terms and conditions of the original Member Agreement & abide by the company’s rules & regulations.


15. For smooth working of the entire process EMI of vehicle and House will be monitored separately. Every applicant will have to abide all the rules and regulations laid by the Transport Department Govt. of Maharashtra as well as CABBZ, ASITPL & MGCPL from time to time. Applicant will have to complete the entire period of 60 months with contractual period of 21 Years without any default of Housing Loan & vehicle EMI as well as stipulated charges, incase of default he will loose his chance to own the vehicle. Upon payment of penal interest and defaulted EMI within stipulated time will restore the claim of the applicant. Company’s decision in this regards will be final and binding on the applicant. Housing loan terms, conditions and loan tenure will be as per the agreement entered with the lending banks any defaults will have to be settled with the lending Bank directly as per their terms and conditions. CABBZ, ASIPL & MGCPL will have rights on the entire Housing scheme till the end of the final Loan EMI as per the various Loan Agreements entered by the Members from time to time.


16. Administrative expenditure of 10% will be deducted from the Customers provided on monthly contracts by the Company’s response centre. Various schemes announced from time to time will be available to all the applicant drivers, who subscribes for the same. Various gift vouchers issued by the company will be redeemed as per the rules and regulations of the prepaid / post paid voucher schemes. All the taxes applicable will be charged to the applicant. Airport operations expenses will be charged extra as per actual expenditure. Fine will be levied for misbehavior and for breach of rules and will be recovered from the defaulted applicants/drivers. Drivers will have to adhere to all the rules and regulations levied by the company from time to time. Continuous misbehavior and breach of rules will result in to temporary / permanent suspension of the contract.


17. In all claims/disputes arise the decision of MY HOME MY CAB / CABBZ / MGCPL / ASITPL will be the final and binding.


18. Please allow a minimum 4-6 weeks of time (from the date of your registration) to deliver the CAB booking documents to you. All the relevant Taxes will be charged by the respective authorities which will be applicable extra.


19. All information regarding MY HOME MY CAB will be available from website: www.cabbz.in Registration can be made only through the website www.cabbz.in or through CABBZ Mobile App or authorized franchisees appointed by the Company (CABBZ / ASITPL / MGCPL) & any prospective person who intends to be a Member should familiarize himself/herself with the terms and conditions & any complaint at a later date will not be entertained under any circumstances.


20. The Membership will be activated only after registering with pre-payment of stipulated payments, which will be registered only through authorized franchisees or through website www.cabbz.in or CABBZ Mobile App. Where there is no franchisee, registration should be done through www.cabbz.in or Mobile App only.


21. At the time of registration, the member should register his/her password &customer login name. The customer login name cannot be changed in any circumstance. The membership ID will be automatically system generated. KYC Documents verification, Physical verification & Police verification shall be a part of Registration process.


22. Members will be given a personalized web page from where they can have their details like: Account Genealogy & enjoy lot of web links which will help members to obtain the information.


23. Genealogy and their accounts related information is proprietary and confidential to the company and is made available to the Members in strict and complete confidence for their own and privilege information & not to disclose to any third party.


24. The effective date of this agreement shall be the date of signing of this agreement through the website. On-line registration should be done by using the pre-payment deposits through Mobile APP, CABBZ HUB franchisees or Mumbai Office.


25. The member of MY HOME MY CAB will indemnify and keep the company indemnified for and against any claim, loss, damage or liability suffered or incurred by the company resulting from a breach of this Agreement by the Member or from any act, neglect or default of the consultant or her/his agents, employees, licensees or clients.


26. The registration documents will be distributed to the members through MY HOME MY CAB/CABBZ/ASITPL/MGCPL or Hub franchisees will be responsible for delivery of the documents. Documents may also be sent through SPEED POST or through reputed Courier.


27. The MY HOME MY CAB management reserves the right to modify their business systems/business plan for the betterment & convenience of its members, at any time without any prior notice and will be binding all the time during the tenure of this agreement. The said changes will be uploaded on website www.cabbz.in


28. MY HOME MY CAB shall not be liable for any non-performance of its obligations or consequences thereof under this agreement due to circumstances beyond its reasonable control.


29. MY HOME MY CAB will not be responsible for any wrong online registration done by its members, but the wrong inputs can be rectified with proper approvals when brought to notice by the member or during statutory audit.


30. The company is not responsible for any unauthorized money transactions for the registration of membership since; registration is done through web based applications only by using pre-payment to be deposited at the authorized franchisees or stipulated Bank Account only.


31. Any and all disputes or differences whatsoever arising between the Parties out of or relating to the construction, meaning or the performance or effect of this Agreement or breach thereof shall be referred to the sole arbitrator in accordance with the Arbitration and Conciliation Act, 1996 as amended from time to time shall be applicable. The venue of arbitration shall be Mumbai.


32. All suits in connection with this business will come under the jurisdiction of courts at Mumbai only. Subject to Bombay High Court jurisdiction only *
